These Terms of Service (Terms) are a legal agreement between you and Ishaan Dimri, a sole trader (ABN 89 966 012 969) — in these Terms, “I”, “me” and “my” refer to Ishaan Dimri (the operator of Ritual). They govern your access to and use of the Ritual mobile application, the website at ritual-app.com.au, and related services (together, the Services).
By creating an account or using the Services, you agree to these Terms and to my Privacy Policy and Copyright & IP Policy. If you do not agree, do not use the Services.
1. About Ritual — important wellbeing notice
Ritual is a wellbeing and communication tool for couples. It offers shared rituals, reflective prompts, and structured, AI-assisted conversations to help partners communicate.
Ritual is not a health service. It is not counselling, psychotherapy, medical, psychological or crisis care, and it does not provide diagnosis, treatment, or professional advice. The AI features are an automated tool, not a therapist or clinician, and may produce inaccurate or incomplete responses. Ritual is not a substitute for professional help.
If you or someone else may be at risk of harm, contact emergency services on 000. Other Australian support lines include Lifeline 13 11 14, 1800RESPECT 1800 737 732, and Beyond Blue 1300 22 4636.
2. Eligibility
You must be at least 16 years old to use the Services and able to form a binding contract under Australian law. If you are 16 or 17, you confirm that a parent or guardian is aware of and consents to your use. You must use the Services only for lawful, personal, non-commercial purposes.
3. Your account
To use most features you must create an account and may link with a partner. You agree to provide accurate information, keep your login credentials secure, and notify me promptly at support@ritual-app.com.au of any unauthorised use. You are responsible for activity that occurs under your account. I may suspend or close accounts that breach these Terms (see clause 11).
4. Linking with a partner
Some features let you connect with a partner so that shared content (such as check-ins, life events, and the daily thread) is visible to both of you. Only connect with a partner who consents. You are each responsible for what you share. If you disconnect, some previously shared content may remain visible to your former partner or in shared records.
5. Subscriptions, billing and refunds
Paid features are sold as subscriptions and are billed through the app store you use (Google Play or the Apple App Store), not directly by me. Your purchase, renewal, free-trial and cancellation terms — and any refunds — are governed by that app store's terms and policies. Subscriptions renew automatically unless cancelled through your app store account before the renewal date. To cancel or request a refund, use your app store's account settings.
Nothing in this clause limits your rights under the Australian Consumer Law (see clause 12).
6. Acceptable use
You agree not to:
- use the Services unlawfully, or to harass, abuse, threaten or harm any person;
- upload content that is unlawful, defamatory, infringing, hateful, or that you do not have the right to share;
- attempt to access, disrupt, reverse-engineer, scrape, or interfere with the Services or their security;
- use the Services to impersonate others, send spam, or for any commercial purpose without my written consent; or
- use the AI features to generate unlawful, harmful, or abusive content.
I may remove content or restrict access where I reasonably believe these Terms have been breached.
6A. Voice notes and recording
Ritual lets you record short voice notes (up to five minutes each) and send them to your linked partner. By using this feature you agree that:
- You control the microphone. The app records only while you have started a recording. It does not record in the background and does not listen at any other time. You may decline or revoke microphone permission at any time in your device settings, and the rest of the Services will continue to work.
- You are responsible for what you record. Clause 6 (Acceptable use) and clause 7 (Your content) apply to voice notes in full.
- You must not record other people without their consent. Recording a private conversation without the consent of the people taking part may be a criminal offence in Victoria and in other places, including under the Surveillance Devices Act 1999 (Vic) and equivalent laws elsewhere. Do not use Ritual to record anyone other than yourself unless every person being recorded knows and agrees. You are solely responsible for complying with the recording laws that apply where you are, and where the person you are sending to is.
- A voice note goes to one person. It is delivered to your linked partner and to nobody else. I do not transcribe voice notes, do not send them to my AI provider, and do not use them for advertising or profiling. See my Privacy Policy, clause 5.
- Your partner can keep it. Once you send a voice note, your partner can listen to it as often as they like, including from the Android home-screen widget while the app is closed, and may be able to save or record it by means outside my control. Deleting a note removes it from the Services, but it does not undo the fact that it was heard. Treat sending a voice note the same way you would treat sending any other message.
- Length and format limits may change. I may set or adjust limits on the length, size, number or retention of voice notes where reasonably necessary to operate the Services.
I may remove a recording, and restrict access to the feature, where I reasonably believe these Terms have been breached.
7. Your content
You retain ownership of the content you submit (Your Content), including photos and voice recordings. You grant me a non-exclusive, royalty-free licence to host, store, reproduce, and process Your Content solely to operate, secure and provide the Services to you and your linked partner (including transmitting conversation text to my AI provider to generate responses — see my Privacy Policy).
You are responsible for Your Content and confirm you have the rights to share it. You can delete Your Content through the app; residual copies may persist in backups for a limited period before deletion.
8. My content and intellectual property
The Services, including their software, design, text, graphics, logos, and the “Ritual” name and branding, are owned by me or my licensors and are protected by the Copyright Act 1968 (Cth) and other laws. I grant you a limited, personal, non-transferable, revocable licence to use the app for its intended purpose. You must not copy, modify, distribute, or create derivative works except as permitted by law.
9. Third-party services
The Services rely on third parties, including Supabase (hosting and database), Anthropic (AI processing), and the Google Play and Apple app stores. Your use of those services may also be subject to their terms. I am not responsible for third-party websites or services linked from the app.
10. Availability and changes to the Services
I aim to keep the Services available but do not guarantee uninterrupted or error-free operation. I may add, change, suspend or discontinue features at any time. Where a change is material and within my control, I will give reasonable notice where practicable.
11. Suspension and termination
You may stop using the Services and delete your account at any time. I may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Services or other users. On termination, your right to use the Services ends; clauses intended to survive (including clauses 7, 8, 12, 13, 14 and 17) continue.
12. Australian Consumer Law and disclaimers
The Services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL). Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the ACL or other law that cannot lawfully be excluded.
Subject to those rights, the Services are otherwise provided “as is” and “as available”, and to the maximum extent permitted by law I exclude all other warranties, including any implied warranty that the Services are fit for a particular purpose, accurate, or that AI-generated content is reliable.
Where I am liable for a failure to comply with a consumer guarantee (other than a guarantee that cannot be limited), my liability is limited, at my option, to re-supplying the Services or paying the cost of re-supply.
13. Limitation of liability
To the maximum extent permitted by law (and subject to clause 12), I am not liable for any indirect, incidental, special or consequential loss, or any loss of data, profits, or goodwill, arising from your use of the Services. To the extent I may lawfully limit my total liability, my aggregate liability to you for all claims is limited to the greater of the amount you paid me for the Services in the 12 months before the claim, or AUD $100.
Because Ritual is a wellbeing tool and not a health or crisis service, I am not responsible for decisions you make based on the Services or AI-generated content (see clauses 1 and 12).
14. Indemnity
To the extent permitted by law, you agree to indemnify me against reasonable claims, losses and costs arising from your unlawful use of the Services, your breach of these Terms, or Your Content, except to the extent caused by me.
15. Privacy
My handling of personal information is described in my Privacy Policy, which forms part of these Terms.
16. Changes to these Terms
I may update these Terms from time to time. If a change is material, I will take reasonable steps to notify you (for example, in-app or by email). Your continued use after the changes take effect means you accept the updated Terms.
17. Governing law and jurisdiction
These Terms are governed by the laws of Victoria, Australia. You and I submit to the non-exclusive jurisdiction of the courts of Victoria and the Commonwealth of Australia. Nothing in this clause limits your right to bring a complaint to a relevant regulator or tribunal.
18. General
These Terms are the entire agreement between you and me about the Services. If any provision is unenforceable, the rest continues in effect. I may assign these Terms (for example, on a sale of the business); you may not assign them without my consent. My failure to enforce a provision is not a waiver. I may give notices in-app or by email; you can contact me at the address below.
